Condition of Vehicle, Title, and Warranties
- The vehicle is sold in its present "AS-IS" condition unless otherwise stated in writing in this Agreement or an attached addendum.

- Seller shall deliver good, marketable, and insurable title at closing, free of liens (other than disclosed), together with all keys, key fobs, owner's manuals, maintenance records, and accessories in Seller's possession.

- Except for any express written warranty provided by a dealer or manufacturer, the vehicle is sold "AS-IS" without any warranties of merchantability or fitness for a particular purpose.

Odometer Disclosure
Seller certifies that to the best of their knowledge the odometer reading reflects the actual mileage the vehicle has been driven. Seller further certifies:
- The odometer has not been altered, set back, or disconnected.

Delivery, Title Transfer, Taxes, and Registration

- Risk of loss, damage, or destruction passes to Buyer upon physical delivery of the vehicle and full payment (or funding of loan).
- Seller agrees to cooperate fully and promptly with any lienholder payoff, title correction, or additional documentation reasonably required to deliver clear title.
Default, Remedies, and Cancellation
- If Buyer fails to complete payment or take delivery as agreed, Seller may retain any deposit or down payment as liquidated damages (to the extent permitted by law) and pursue additional remedies available under Texas law.
- If Seller is unable to deliver clear title or the vehicle substantially as described, Buyer may cancel this Agreement and receive a full refund of all amounts paid, subject to any good-faith deductions permitted by law.
- Either party may cancel this Agreement by mutual written consent signed by both parties.
