Expanded Massachusetts Consumer Protections and Instructions
- Under M.G.L. Chapter 93A, unfair or deceptive acts in vehicle sales are prohibited; failure to disclose known defects can give rise to claims for damages and attorneys fees.
- Private sellers are generally not "merchants" but still must avoid affirmative misrepresentations.
- The Massachusetts Registry of Motor Vehicles (RMV) requires proper title transfer; both parties should retain copies of all disclosures for at least five years.
- Odometer disclosure must accompany title applications in most cases.
- If the vehicle has a branded title (salvage, rebuilt, lemon buyback), it must be prominently disclosed on the title and in writing.
- Buyers are encouraged to obtain a pre-purchase inspection from a licensed MA inspection station.
- Payment of sales tax or use tax is required upon titling; current rates and any local assessments should be confirmed with RMV.
- No cooling-off or right of rescission generally applies to private used vehicle sales in Massachusetts.
