Section 7 - Illinois Title Transfer Steps
After this bill of sale is executed, the following steps apply to complete the transfer:
- Seller signs the back of the title. The seller must sign and date the assignment section on the back of the Illinois (or out-of-state) certificate of title and complete the odometer disclosure on the title document.
- Buyer presents documents to the Secretary of State vehicle services office. Bring the signed title, this bill of sale, a valid government-issued photo ID, and proof of Illinois liability insurance.
- Pay Illinois sales/use tax and fees. Illinois imposes a use tax reported on Form RUT-50 (Private Party Vehicle Use Tax) - a flat amount based on the vehicle's model year for purchase prices under $15,000, or tax on the actual purchase price for $15,000 and above, plus the Illinois title fee (currently $165.00) and registration fees based on vehicle class.
- Meet the transfer deadline. Illinois requires the buyer to complete title transfer within 20 days of the sale (625 ILCS 5/3-114). Form RUT-50 and any tax due must also be filed within 30 days of the purchase date regardless of whether the title application is complete - Illinois assesses separate penalty and interest for a late RUT-50 even if the title itself is filed on time.
- Receive new Illinois title and registration. The Secretary of State vehicle services office processes the transfer and issues a new Illinois certificate of title in the buyer's name, along with registration and license plates.
- Lien notation (if financed). If the buyer is financing the purchase, the lender's name and address must be listed on the title application as the first lienholder. The lender holds the title until the loan is satisfied.
