Section 7 - Warranty / As-Is Status

AS-IS - NO DEALER WARRANTY
> The vehicle described in this agreement is sold AS IS. The dealer/seller makes no warranty, express or implied, regarding the vehicle's condition, fitness, or merchantability. The buyer assumes full responsibility for the vehicle from the moment of delivery. Any existing defects, whether known or unknown to the seller, are the buyer's responsibility.
> Implied Warranties Disclaimed: To the fullest extent permitted by Delaware law, all implied warranties - including the implied warranty of merchantability and the implied warranty of fitness for a particular purpose - are hereby DISCLAIMED. This disclaimer is valid under Delaware's Uniform Commercial Code (Del. Code tit. 6, § 2-316) when made in a conspicuous manner in writing.
> Federal Warranty Rule (FTC Magnuson-Moss, 16 C.F.R. Part 455): Dealers selling used vehicles must display a Federal Trade Commission (FTC) Buyers Guide on the vehicle. A copy of the signed Buyers Guide forms part of this agreement. The Buyers Guide controls if there is a conflict between it and this agreement regarding warranty status.

Section 9 - Cancellation / Rescission Policy
> Delaware does not provide a statutory 2-day right to cancel a used-vehicle purchase (unlike California, which offers a 2-business-day cancellation option under Cal. Veh. Code § 11713.21 for used vehicles priced under $40,000). Once this agreement is signed and the vehicle is delivered in Delaware, the sale is final unless:
- The dealer voluntarily offers a contractual cancellation option (described below), or
- The buyer has a legal rescission right under federal or state consumer-fraud law (e.g., the FTC Holder Rule, Delaware Consumer Fraud Act, Del. Code tit. 6, § 2511 et seq.).
Dealer Cancellation Option (if offered):

Section 10 - Delaware DMV Title Transfer Steps
After this agreement is executed and the vehicle is delivered, the following steps must be completed to transfer title in Delaware:
- Obtain signed title from seller. The seller must sign the back of the existing Delaware certificate of title (or out-of-state equivalent) in the "Seller's Signature" section and complete the odometer disclosure on the title if required.
- Complete Bill of Sale (Form MV-186 or equivalent). A Delaware Bill of Sale or this signed purchase agreement serves as proof of sale. Retain a copy for your records.
- Gather required documents. Buyer brings to the DMV: (a) signed title, (b) this signed purchase agreement or bill of sale, (c) government-issued photo ID, (d) proof of Delaware auto insurance (minimum 15/30/10 liability), and (e) payment for fees.
- Pay Delaware Document Fee (4.25%). The buyer pays the Delaware document fee (transfer tax) - currently 4.25% of the purchase price - directly to the DMV at time of title transfer.
- Pay title and registration fees. Current Delaware title fee: $55 (subject to change). Registration fees vary by vehicle weight and type.
- Receive new Delaware title and registration. The DMV issues a new Delaware certificate of title listing the buyer (and lien holder, if financed) and new registration/license plates (or transfers existing plates).
- Lien notation (if financed). If the vehicle is financed, the lender's name and address must be listed on the title application as the first lien holder. The lender typically holds the title until the loan is paid in full.
- Out-of-state titles. If the vehicle has an out-of-state title, the buyer must also complete a Delaware VIN inspection. Contact the Delaware DMV for current inspection requirements.

Section 12 - Governing Law and Dispute Resolution
- This agreement is governed by the laws of the State of Delaware, including the Delaware Uniform Commercial Code (Del. Code tit. 6) and the Delaware Motor Vehicle Code (Del. Code tit. 21).

- If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
